Principles for the protection of personal data of Finesta Baltic OÜ.

  1. The principles for the protection of personal data have been published in order to comply with Article 13 of Regulation No 2016/679/EU (“General Regulation”). In the event of a conflict between the Regulation and these principles, the Regulation applies. 
  2. We undertake to process any personal data related to you provided to us or received by us (via this website, via a customer account, via email or otherwise) by the way provided for in the principles- If you provide us with your information in a manner that does not allow you to ask for your consent (such as sending an e-mail or  description of a person and using the website, you confirm your consent for using your personal data in accordance with the purposes provided by you and these principles.

If you submit applications for us to stand as a candidate, for recruitment or labor force rental, we may use third-party assistance with your explicit consent, including submitting an enquiry to your current and former employers and colleagues, the persons and authorities recommending you for verifying your identity and personal data submitted by you to us, and for credit institutions for making credit decisions related to you. We may also request and disclose information to legitimate authorities, security organizations and other relevant third parties for the purpose of preventing, investigating, detecting or prosecuting offenses or for enforcing criminal penalties, including for the protection and prevention of threats to public security. 
  6. We will not sell your personal data to anyone or disclose it now or in the future without the basis provided by the General Regulation. You are required to provide the correct personal information to use the service. Failure to submit data or submission of false information or the withdrawal of consent to the processing of personal data, we are entitled to apply the appropriate legal remedies. Automated decisions are not made in recruitment decisions, i.e., decisions are reviewed by a person who pays particular attention to circumstances that are relevant to recruitment (for example, qualifications and prior professional experience). 
  7. Personal data processing is carried out, in particular by sending a personal description to Finesta via the Finesta portal and via e-mail. The data collected is primarily your first and last name, contact information, age, qualifications and skills, a description of your work experience, a description of your interests and hobbies, the exchange of information with us, the IP address and other data automatically transmitted by the device to us. It is possible to save calls to our customer support and from the customer support services for recruitment purposes, including solving any queries related to the service provided to you. We may contact the service user from time to time to obtain additional information regarding being selected in the recruitment process. 
  8. The purpose and legal basis for the processing of personal data: for the purpose of providing the service and performing contractual obligations, the purpose of which is the organization of the leasing of labor, the provision of recruitment services or the standing as a candidate – General Data Protection Regulation Article 6 (1) (a) and (b); for processing customer’s complaints and appeals – under General Data Protection Regulation Article Art. 6 (1) c), Art. 9 (2) f); Conclusion and performance of contracts for the recruitment of Finesta’s own staff or for the purchase of services or goods for the activities – under Art. 6 (1) b); preventing fraud and ensuring cyber-security, including automatic processing of data on security devices and security programs, such as firewalls, spam filters, video surveillance, including video surveillance on vehicles -under Art. 6 (1) f), Art. 9 (2) f); IP addresses and other data identifying the computer or smart device and thus the user –  Preamble c 49 of the General Data Protection Regulation Article; With your express consent to receive a newsletter – under Art. 6 (1) a); your explicit consent for information for market research – under General Data Protection Regulation Article Art. 6 (1) a); with your express consent – the installation of cookies under General Data Protection Regulation Article Art. 6 (1) a)l. 
  9. Personal data may be forwarded to persons who provide the services necessary for the operation of the controller (e.g., information society service providers) or sell goods to the controller (authorized processors) as well as to authorities of the state authorities in cases provided for by law. Authorized processors or data receivers may be located outside the European Union if they are in a recognized country with an adequate level of data protection (vt or is a United States company with a certificate of Privacy Shield (Article 45 of the General Data Protection Regulation Article Art). If you visit our site from outside the European Union or provide  means of communications and contact information for communication with you that are located outside the European Union or in other similar exceptional cases, then we will transfer your personal data to the relevant country under Article 49 (1) (b) of the General Regulation, under the preamble of the General Regulation, c. 113, also if these countries are not countries with adequate recognized levels and the company does not have the certificate of Privacy Shield. 
  10. If the processing of personal data is initiated for a purpose other than that for which personal data was collected, we will seek your prior consent for this purpose.
  11. In order to prove the legality of the labor mediation service, we will retain the information for a certain period after termination of the labor mediation service, usually not more than 18 months. Preservation of data takes place in accordance with these principles.
  12. We will take all reasonable measures to ensure the safety and security of your data. 
  13. The personal data of children deserve special protection. We process the personal data of a minor only with the prior consent of the minor’s legal representative. Data sent to us without prior consent will be deleted. 
  14. We have the right to change these principles at any time. Changes regarding you will enter into force immediately after you confirm your consent in your customer’s profile or express it otherwise.

You have the right to request access from the controller to personal data relating to the data subject and to correct or erase them or to restrict the processing of personal data, or to object to the processing of such personal data, or to require the transmission of your data to a person of your choice. When we process data under General Regulation Art. 6 (1) (a), you have the right to withdraw at any time the consent to the processing of personal data without affecting the legality of the processing performed prior to the withdrawal.
